These Terms and Conditions of Sale (the “Terms and Conditions”) govern the sale of newspapers, magazines, publications and, where applicable, subscriptions and digital content offered by PROPAGANDA VULGARIS (the “Seller”) to consumers (the “Customer”) in Belgium, France and the United Kingdom.

Sales are intended exclusively for individuals acting for purposes which are outside the scope of their trade, business, craft or profession (“consumers”), unless otherwise stated.

1. SELLER IDENTIFICATION

2. PURPOSE

These Terms and Conditions set out the rights and obligations of the Seller and the Customer in connection with the distance sale of printed publications, subscriptions and, where applicable, digital content offered on the website www.propagandavulgaris.com.

The main characteristics of each product, its price, any applicable delivery charges, delivery arrangements and, where applicable, the duration and terms of the subscription are provided to the Customer before the order is confirmed.

3. ACCEPTANCE OF THE TERMS AND CONDITIONS

Any order placed on the website constitutes prior acceptance of these Terms and Conditions.

The Customer is invited to read these Terms and Conditions before completing an order.

The Terms and Conditions applicable to an order are those made available to the Customer at the time the order is placed.

The Seller recommends that the Customer retain a copy of these Terms and Conditions and the order confirmation.

4. PRODUCTS

The Seller offers, in particular:

  1. individual issues of the newspaper or magazine;
  2. newspaper or magazine subscriptions;
  3. digital content;
  4. additional products offered on the website.

The main characteristics of each product are presented on the relevant product page.

Photographs and illustrations displayed on the website are intended to present the products. Minor differences in appearance may occur, particularly as a result of printing processes or screen display settings.

The Seller reserves the right to modify the layout, cover, editorial content or certain graphic elements of a publication before printing, provided that such changes do not materially alter the essential characteristics of the product ordered.

5. PRICES

Prices are stated in the currency applicable at the time of purchase.

Unless otherwise stated, prices displayed to consumers include all legally applicable taxes.

Any additional charges, including delivery charges, are disclosed to the Customer before the order is finally confirmed.

The applicable price is the price displayed at the time the order is confirmed.

The Seller reserves the right to change its prices for future orders. A price change shall not apply retroactively to an order that has already been confirmed.

6. ORDERS

The Customer selects the product or products they wish to purchase and adds them to their shopping cart.

Before confirming the order, the Customer may review the order details and correct any errors.

The Customer then confirms the order and makes payment using one of the payment methods offered.

Where placing an order entails an obligation to pay, the Customer is clearly informed of this before final confirmation of the order.

Confirmation of the order constitutes an obligation to pay on the part of the Customer.

Once payment has been successfully confirmed, the Customer receives an order confirmation at the email address provided when placing the order.

The sales contract is concluded when the Seller confirms the order, subject to applicable statutory provisions.

The Seller reserves the right to refuse or cancel an order in the event of:

  1. non-payment;
  2. an obvious error concerning the price or characteristics of the product;
  3. exceptional unavailability of the product;
  4. a reasonable suspicion of fraud;
  5. an inability to deliver the product to the address provided.

If an order that has already been paid for is cancelled, the amounts corresponding to products that are not supplied will be refunded to the Customer.

7. PAYMENT METHODS

The payment methods available are indicated during the ordering process.

Payment is due at the time the order is placed, unless otherwise stated.

Transactions may, where applicable, be processed by a secure third-party payment service provider.

The Seller does not retain complete payment card details where these are processed directly by its payment service provider.

8. DELIVERY

The Seller delivers products to the territories indicated on the website at the time of purchase.

The estimated delivery period or date is indicated during the ordering process.

Where the product is an issue that is already available, it will be dispatched within 3 business days following confirmation of the order, unless otherwise stated.

For publications that have not yet been released, the estimated dispatch date is indicated on the product page or in the order confirmation.

Delivery times may be affected by events beyond the Seller's control, including disruptions to postal or carrier services.

However, the Seller shall not exclude or limit any rights to which consumers are legally entitled in the event of delayed or failed delivery.

9. TRANSFER OF RISK

For consumers, the risk of loss of or damage to the product shall transfer in accordance with the mandatory rules applicable in the Customer's country of residence.

Nothing in these Terms and Conditions shall have the effect of transferring to the consumer any risk which, under applicable law, must remain with the Seller until delivery.

10. SUBSCRIPTIONS

Where a subscription is offered, its duration, price, delivery frequency and, where applicable, whether it automatically renews are stated before the contract is concluded.

Where a subscription is entered into for a fixed term, it shall end at the end of the stated subscription period, unless renewal is provided for under the terms of the offer.

Where a subscription automatically renews, the Customer is informed before entering into the contract of:

  1. the initial subscription period;
  2. its price;
  3. the frequency of charges;
  4. the duration and terms of renewal;
  5. the means by which the renewal may be terminated.

No automatic renewal shall take place unless this feature has been clearly brought to the Customer's attention before the order is placed.

11. RIGHT OF WITHDRAWAL — INDIVIDUAL ISSUES

In accordance with applicable consumer protection legislation, the right of withdrawal does not apply in Belgium and France to the supply of a newspaper, periodical or magazine sold as an individual issue.

This exception does not apply to subscription contracts for such publications.

Accordingly, where a Customer located in Belgium or France orders an individual issue of the newspaper or magazine, they do not have the statutory 14-day right of withdrawal solely because the purchase was made at a distance.

This exception does not affect the Customer's statutory rights in the event of a defective, non-conforming or damaged product.

Important: the rules applicable in the United Kingdom are governed by the applicable UK consumer legislation.

12. RIGHT OF WITHDRAWAL — SUBSCRIPTIONS

Where a consumer Customer enters into a subscription contract at a distance, they shall have a statutory withdrawal period of fourteen (14) days where provided for by applicable law.

For a subscription to a printed publication, the withdrawal period begins to run in accordance with the applicable rules concerning receipt of the first issue where those rules provide for such a starting point.

The Customer may exercise their right of withdrawal without giving any reason.

To exercise this right, the Customer may send the Seller a clear statement setting out their decision to withdraw from the contract or use the model withdrawal form set out in Article 13 of these Terms and Conditions.

The request may be submitted through our contact page.

Where the Customer validly exercises their right of withdrawal, the Seller shall refund the amounts due in accordance with the time limits and procedures provided for by applicable law.

Where several issues have already been delivered before the right of withdrawal is exercised, the financial consequences of those deliveries shall be determined in accordance with the law applicable to the relevant contract.

The Seller may not impose any fees or penalties on the consumer that are not authorised by applicable law.

The Customer is not required to use this form provided that they submit an unequivocal statement clearly expressing their decision to withdraw from the contract.

14. REFUNDS FOLLOWING WITHDRAWAL

Where a right of withdrawal applies and is validly exercised, the Seller shall refund the amounts due in accordance with the time limits provided for by applicable law.

The refund shall be made using the same means of payment as that used for the original transaction, unless otherwise agreed with the Customer or unless this is legally or technically impossible.

Where permitted by applicable law, the Seller may withhold the refund until the relevant goods have been recovered or until the Customer has provided evidence that the goods have been dispatched.

15. STATUTORY CONSUMER GUARANTEE OF CONFORMITY

Consumer Customers benefit from the statutory guarantees applicable in their country of residence.

Nothing in these Terms and Conditions limits or excludes any mandatory rights to which consumers are entitled in relation to conformity, defects or damaged products.

If the Customer receives a defective or damaged copy, or a product that does not correspond to the order, they are invited to contact us.

Where possible, please provide:

  • the order number;
  • the product concerned;
  • the nature of the problem;
  • a photograph of the product where the defect is visible.

The Seller shall provide the Customer with the remedy required under applicable law, which may include replacement of the product, repair where appropriate, a price reduction or a refund.

16. PRODUCTS DAMAGED IN TRANSIT

If a product arrives visibly damaged, the Customer is invited to contact the Seller as soon as reasonably possible in order to facilitate the handling of the claim.

This request does not constitute an additional condition for exercising the consumer's statutory rights.

17. AVAILABILITY OF PUBLICATIONS

Publications are offered subject to availability and while stocks last.

If a product becomes unavailable after an order has been placed, a new estimated availability date will be communicated to the Customer.

18. INTELLECTUAL PROPERTY

The publications, texts, photographs, illustrations, graphics, logos, editorial elements, trademarks and other content offered by the Seller are protected by applicable intellectual property laws.

Unless expressly authorised by the Seller or otherwise permitted by law, no reproduction, distribution, modification, public communication or commercial exploitation of all or part of such content may be carried out.

The purchase of a copy of the newspaper does not transfer any intellectual property rights to the Customer.

19. DIGITAL CONTENT

Where the Seller offers a digital edition or other digital content, its characteristics, access arrangements and any technical limitations are disclosed before the order is placed.

Where the supply of digital content begins immediately after the order, the Customer may, where required by applicable law, be asked to expressly consent to the immediate performance of the contract and acknowledge any legal consequences this may have for their right of withdrawal.

20. CUSTOMER SERVICE AND COMPLAINTS

Any question or complaint may be submitted here.

The Seller endeavours to respond to complaints within a reasonable period.

Contacting customer service does not deprive the consumer of any statutory rights.

21. ALTERNATIVE DISPUTE RESOLUTION

The Seller endeavours to resolve any dispute with a Customer amicably.

For consumers residing in Belgium, the Customer may, where the relevant conditions are met, contact the competent mediation service or the competent consumer protection authority.

For consumers residing in France, the Customer may, where the statutory conditions are met, contact the competent mediation service or the competent consumer protection authority.

For consumers residing in the United Kingdom, the Customer may, where the statutory conditions are met, contact the competent mediation service or the competent consumer protection authority.

Nothing in this Article prevents a consumer from exercising their rights before the competent courts.

22. PERSONAL DATA

Personal data collected when an order is placed is processed in accordance with the Seller's Privacy Policy.

Data is processed in accordance with applicable personal data protection laws, including the GDPR where applicable, as well as the UK data protection rules applicable to Customers located in the United Kingdom.

Data may be used, in particular, to:

  1. process and dispatch orders;
  2. process payments;
  3. provide customer service;
  4. manage subscriptions;
  5. comply with legal and accounting obligations;
  6. prevent fraud.

Detailed information regarding the processing of personal data is provided in the Privacy Policy.

23. MARKETING COMMUNICATIONS

The Seller may send electronic marketing communications where permitted by applicable law and where the requirements for sending such communications have been met.

The Customer may unsubscribe from marketing communications at any time by using the unsubscribe link provided in the relevant communication or by following the procedure described in the Privacy Policy.

Communications necessary for the performance of the contract or the management of an order do not constitute marketing communications.

24. LIABILITY

The Seller is liable in accordance with applicable law.

Nothing in these Terms and Conditions shall have the effect of:

  1. excluding liability that cannot legally be excluded;
  2. limiting the consumer's mandatory rights;
  3. removing or reducing any applicable statutory guarantees.

The Seller shall not be liable for any delay or failure to perform resulting from an event beyond its reasonable control where applicable law permits such a limitation.

25. FORCE MAJEURE

The Seller shall not be liable for any failure to perform or delay directly attributable to an event beyond its reasonable control, including a natural disaster, fire, major technical failure, strike, significant disruption to postal or transport services, general failure of communications networks or a similar event.

This clause does not limit the consumer's mandatory statutory rights.

26. AMENDMENTS TO THE TERMS AND CONDITIONS

The Seller may amend these Terms and Conditions for future orders.

The Terms and Conditions applicable to an order are those accepted by the Customer at the time the order is placed.

Where an amendment affects an ongoing subscription, the Seller shall comply with applicable legal requirements and, where necessary, inform the Customer in advance.

27. GOVERNING LAW AND CONSUMER PROTECTION

These Terms and Conditions shall be interpreted in accordance with the law applicable to the contract.

Where the Customer is a consumer residing in a country whose mandatory consumer protection provisions apply to the contract, those provisions shall remain applicable even where another law has been designated as the governing law.

Nothing in these Terms and Conditions deprives the consumer of any mandatory protections to which they are entitled under the law of their country of residence where such protections apply.

28. JURISDICTION

In the event of a dispute with a consumer, the rules governing jurisdiction applicable in the consumer's country of residence shall be respected.

The consumer may exercise any remedies available to them under applicable law.

29. SEVERABILITY

If any provision of these Terms and Conditions is declared invalid, unlawful or unenforceable, such invalidity shall not affect the remaining provisions, to the extent permitted by applicable law.

Where legally possible, the provision concerned shall be interpreted or replaced in a manner that most closely achieves its original purpose while remaining compliant with applicable law.

30. NO WAIVER

The Seller's failure to immediately exercise or enforce any right provided for under these Terms and Conditions shall not constitute a waiver of that right.

31. LANGUAGE OF THE TERMS AND CONDITIONS

These Terms and Conditions are drafted in English.

Where they are translated into another language, the version applicable to the Customer shall be the version presented to them in accordance with the mandatory rules applicable to the contract.

Les présentes Conditions Générales de Vente (« CGV ») régissent les ventes de journaux, magazines, publications et, le cas échéant, abonnements et contenus numériques proposés par PROPAGANDA VULGARIS (« le Vendeur ») aux consommateurs (« le Client ») en Belgique, en France et au Royaume-Uni.

La vente est destinée exclusivement aux personnes physiques agissant à des fins qui n’entrent pas dans le cadre de leur activité professionnelle (« consommateurs »), sauf indication contraire.

1. IDENTIFICATION DU VENDEUR

2. OBJET

Les présentes CGV ont pour objet de définir les droits et obligations du Vendeur et du Client dans le cadre de la vente à distance de publications imprimées, d’abonnements et, le cas échéant, de contenus numériques proposés sur le site www.propagandavulgaris.com

Les caractéristiques essentielles de chaque produit, son prix, les éventuels frais de livraison, les modalités de livraison ainsi que, lorsqu’il y a lieu, la durée et les conditions de l’abonnement sont indiqués au Client avant la validation de sa commande.

3. ACCEPTATION DES CGV

Toute commande passée sur le site implique l’acceptation préalable des présentes CGV.

Le Client est invité à prendre connaissance des présentes CGV avant de finaliser sa commande.

Les CGV applicables sont celles qui sont accessibles au Client au moment de la commande.

Le Vendeur recommande au Client de conserver une copie des présentes CGV ainsi que de la confirmation de commande.

4. PRODUITS

Le Vendeur propose notamment :

  1. des numéros individuels du journal ou magazine ;

  2. des abonnements au journal ou magazine ;

  3. des contenus numériques ;

  4. des produits complémentaires proposés sur le site.

Les caractéristiques essentielles de chaque produit sont présentées sur la page qui lui est consacrée.

Les photographies et illustrations présentées sur le site sont destinées à présenter les produits. De légères différences d’aspect peuvent exister, notamment en raison des procédés d’impression ou des conditions d’affichage à l’écran.

Le Vendeur se réserve le droit de modifier la mise en page, la couverture, le contenu éditorial ou certains éléments graphiques d’une publication avant son impression, sous réserve de ne pas modifier substantiellement les caractéristiques essentielles du produit commandé.

5. PRIX

Les prix sont indiqués dans la devise applicable lors de la commande.

Sauf indication contraire, les prix affichés au consommateur incluent les taxes légalement applicables.

Les éventuels frais supplémentaires, notamment les frais de livraison, sont indiqués au Client avant la validation définitive de la commande.

Le prix applicable est celui affiché au moment de la validation de la commande.

Le Vendeur se réserve le droit de modifier ses prix pour les commandes futures. Une modification de prix ne s’applique pas rétroactivement à une commande déjà confirmée.

6. COMMANDES

Le Client sélectionne le ou les produits qu’il souhaite acheter et les ajoute à son panier.

Avant la validation de la commande, le Client peut vérifier le détail de celle-ci et corriger les éventuelles erreurs.

Le Client confirme ensuite sa commande et procède au paiement selon le moyen de paiement proposé.

Lorsque la commande entraîne une obligation de paiement, le Client en est clairement informé avant sa validation définitive.

La validation de la commande constitue une obligation de paiement pour le Client.

Après validation du paiement, le Client reçoit une confirmation de commande à l’adresse électronique communiquée lors de la commande.

Le contrat de vente est conclu lorsque le Vendeur a confirmé la commande, sous réserve des dispositions légales applicables.

Le Vendeur se réserve le droit de refuser ou d’annuler une commande en cas de :

  1. défaut de paiement ;
  2. erreur manifeste concernant le prix ou les caractéristiques du produit ;
  3. indisponibilité exceptionnelle du produit ;
  4. suspicion raisonnable de fraude ;
  5. impossibilité de livrer le produit à l’adresse indiquée.

En cas d’annulation d’une commande déjà payée, les sommes correspondant aux produits non fournis seront remboursées au Client.

7. MOYENS DE PAIEMENT

Les moyens de paiement disponibles sont indiqués lors du processus de commande.

Le paiement est exigible au moment de la commande, sauf indication contraire.

Les transactions sont traitées, le cas échéant, par un prestataire de paiement tiers sécurisé.

Le Vendeur ne conserve pas les données complètes de carte bancaire lorsque celles-ci sont traitées directement par son prestataire de paiement.

8. LIVRAISON

Le Vendeur livre les produits dans les territoires indiqués sur le site au moment de la commande.

Le délai ou la date estimée de livraison est indiqué lors de la commande.

Lorsque le produit est un numéro déjà disponible, celui-ci est expédié dans un délai de 3 jours ouvrables après confirmation de la commande, sauf indication contraire.

Pour les publications à paraître, la date prévisionnelle d'expédition est indiquée sur la page du produit ou dans la confirmation de commande.

Les délais de livraison peuvent être affectés par des événements indépendants de la volonté du Vendeur, notamment des perturbations des services postaux ou des transporteurs.

Le Vendeur ne saurait toutefois exclure ou limiter les droits dont bénéficie légalement le consommateur en cas de retard ou de défaut de livraison.

9. TRANSFERT DES RISQUES

Pour les consommateurs, le risque de perte ou d’endommagement du produit est transféré conformément aux règles impératives applicables dans le pays de résidence du Client.

Aucune disposition des présentes CGV n’a pour effet de transférer au consommateur un risque qui doit légalement rester à la charge du Vendeur jusqu’à la livraison.

10. ABONNEMENTS

Lorsqu’un abonnement est proposé, sa durée, son prix, sa fréquence de livraison et, le cas échéant, son caractère renouvelable automatiquement sont indiqués avant la conclusion du contrat.

Lorsque l’abonnement est conclu pour une durée déterminée, il prend fin à l’issue de la période indiquée, sauf renouvellement prévu dans les conditions de l’offre.

Lorsqu’un abonnement est reconduit automatiquement, le Client est informé avant la conclusion du contrat :

  1. de la durée initiale de l’abonnement ;
  2. de son prix ;
  3. de la fréquence des prélèvements ;
  4. de la durée et des conditions de renouvellement ;
  5. des modalités permettant de mettre fin au renouvellement.

Aucun renouvellement automatique ne sera effectué sans que cette caractéristique ait été clairement portée à la connaissance du Client avant la commande.

11. DROIT DE RÉTRACTATION — NUMÉROS VENDUS À L’UNITÉ

Conformément aux dispositions applicables en matière de protection des consommateurs, le droit de rétractation ne s’applique pas, en Belgique et en France, à la fourniture d’un journal, d’un périodique ou d’un magazine vendu à l’unité.

Cette exception ne s’applique pas aux contrats d’abonnement à ces publications.

En conséquence, lorsqu’un Client situé en Belgique ou en France commande un numéro individuel du journal ou du magazine, il ne bénéficie pas du droit légal de rétractation de 14 jours du seul fait qu’il s’agit d’un achat à distance.

Cette exception ne prive toutefois pas le Client de ses droits légaux en cas de produit défectueux, non conforme ou endommagé.

Important : les règles applicables au Royaume-Uni sont régies par le droit britannique applicable au consommateur concerné.

12. DROIT DE RÉTRACTATION — ABONNEMENTS

Lorsqu’un Client consommateur souscrit un abonnement à une publication à distance, il bénéficie, lorsque la loi applicable le prévoit, d’un délai légal de rétractation de quatorze (14) jours.

Pour un abonnement à une publication imprimée, le délai commence à courir conformément aux règles applicables à la réception du premier exemplaire lorsque celles-ci prévoient ce mode de calcul.

Le Client peut exercer son droit de rétractation sans avoir à justifier sa décision.

Pour exercer ce droit, le Client peut envoyer au Vendeur une déclaration claire exprimant sa décision de se rétracter ou utiliser le formulaire de rétractation figurant à l’article 13 des présentes CGV.

La demande peut être envoyée via notre page de contact.

Lorsque le Client exerce valablement son droit de rétractation, le Vendeur rembourse les sommes dues conformément aux délais et modalités prévus par la législation applicable.

Lorsque plusieurs exemplaires ont déjà été livrés avant l’exercice du droit de rétractation, les conséquences financières de ces livraisons sont déterminées conformément au droit applicable au contrat concerné.

Le Vendeur ne peut imposer au consommateur des frais ou pénalités qui ne sont pas autorisés par la législation applicable.

13. FORMULAIRE TYPE DE RÉTRACTATION

Le Client n’est pas obligé d’utiliser ce formulaire dès lors qu’il transmet une déclaration dénuée d’ambiguïté exprimant clairement sa décision de se rétracter.

14. REMBOURSEMENT EN CAS DE RÉTRACTATION

Lorsque le droit de rétractation est applicable et valablement exercé, le Vendeur rembourse les sommes dues conformément aux délais prévus par la législation applicable.

Le remboursement est effectué par le même moyen de paiement que celui utilisé lors de la transaction, sauf accord contraire avec le Client ou impossibilité légale ou technique.

Le Vendeur peut, lorsque la loi applicable le permet, différer le remboursement jusqu’à récupération des biens concernés ou jusqu’à ce que le Client fournisse la preuve de leur expédition.

15. GARANTIE LÉGALE DE CONFORMITÉ

Le Client consommateur bénéficie des garanties légales applicables dans son pays de résidence.

Aucune disposition des présentes CGV ne limite ou n’exclut les droits impératifs dont bénéficie le consommateur en matière de conformité, de défaut ou de produit endommagé.

En cas de réception d’un exemplaire défectueux, endommagé ou ne correspondant pas à la commande, le Client est invité à nous contacter.

en indiquant, dans la mesure du possible :

  • le numéro de commande ;
  • le produit concerné ;
  • la nature du problème ;
  • une photographie du produit lorsque le défaut est visible.

Le Vendeur proposera au Client la solution prévue par la législation applicable, qui peut notamment comprendre le remplacement du produit, la réparation lorsqu’elle est pertinente, une réduction du prix ou le remboursement.

16. PRODUITS ENDOMMAGÉS PENDANT LE TRANSPORT

Si le produit arrive manifestement endommagé, le Client est invité à contacter le Vendeur dans les meilleurs délais afin de faciliter le traitement de la réclamation.

Cette demande ne constitue pas une condition supplémentaire à l’exercice des droits légaux du consommateur.

17. DISPONIBILITÉ DES PUBLICATIONS

Les publications sont proposées dans la limite des stocks disponibles.

En cas d’indisponibilité d’un produit après la commande, une nouvelle date de disponibilité sera communiquée au client.

18. PROPRIÉTÉ INTELLECTUELLE

Les publications, textes, photographies, illustrations, graphismes, logos, éléments éditoriaux, marques et autres contenus proposés par le Vendeur sont protégés par les règles applicables en matière de propriété intellectuelle.

Sauf autorisation expresse du Vendeur ou disposition légale contraire, aucune reproduction, distribution, modification, représentation publique ou exploitation commerciale de tout ou partie des contenus ne peut être effectuée.

L’achat d’un exemplaire du journal ne transfère aucun droit de propriété intellectuelle au Client.

19. CONTENU NUMÉRIQUE

Lorsque le Vendeur propose une édition numérique ou un autre contenu numérique, les caractéristiques, modalités d'accès et éventuelles limitations techniques sont indiquées avant la commande.

Lorsque la fourniture d'un contenu numérique commence immédiatement après la commande, le Client peut être invité, lorsque la loi applicable l'exige, à donner son consentement exprès à cette exécution immédiate et à reconnaître les conséquences légales éventuelles concernant son droit de rétractation.

20. SERVICE CLIENT ET RÉCLAMATIONS

Toute question ou réclamation peut être adressée ici.

Le Vendeur s'efforce de répondre aux réclamations dans un délai raisonnable.

Le fait de contacter le service client ne prive pas le consommateur de ses droits légaux.

21. RÈGLEMENT EXTRAJUDICIAIRE DES LITIGES

Le Vendeur s'efforce de résoudre à l'amiable toute difficulté avec un Client.

Pour les consommateurs résidant en Belgique, le Client peut, lorsque les conditions sont remplies, s'adresser au service de médiation compétent ou à l'autorité compétente en matière de protection des consommateurs.

Pour les consommateurs résidant en France, le Client peut, lorsque les conditions légales sont remplies, s'adresser au service de médiation compétent ou à l'autorité compétente en matière de protection des consommateurs.

Pour les consommateurs résidant au Royaume Uni, le Client peut, lorsque les conditions légales sont remplies, s'adresser au service de médiation compétent ou à l'autorité compétente en matière de protection des consommateurs.

Aucune disposition du présent article n'empêche le consommateur d'exercer ses droits devant les juridictions compétentes.

22. DONNÉES À CARACTÈRE PERSONNEL

Les données personnelles collectées lors d'une commande sont traitées conformément à la Politique de confidentialité du Vendeur.

Le traitement des données est effectué conformément aux règles applicables en matière de protection des données personnelles, notamment au RGPD lorsque celui-ci est applicable, ainsi qu'aux règles britanniques applicables aux Clients situés au Royaume-Uni.

Les données sont notamment susceptibles d'être utilisées afin de :

  1. traiter et expédier les commandes ;
  2. gérer les paiements ;
  3. assurer le service client ;
  4. gérer les abonnements ;
  5. respecter les obligations légales et comptables ;
  6. prévenir les fraudes.

Les conditions détaillées du traitement des données sont précisées dans la Politique de confidentialité.

23. COMMUNICATIONS COMMERCIALES

Le Vendeur peut envoyer des communications commerciales électroniques lorsque celles-ci sont autorisées par la législation applicable et lorsque les conditions nécessaires à leur envoi sont remplies.

Le Client peut se désabonner des communications commerciales à tout moment au moyen du lien de désinscription prévu dans les communications concernées ou selon les modalités indiquées dans la Politique de confidentialité.

La réception de communications nécessaires à l'exécution du contrat ou à la gestion d'une commande ne constitue pas une communication commerciale.

24. RESPONSABILITÉ

Le Vendeur est responsable conformément aux règles légales applicables.

Aucune disposition des présentes CGV ne saurait avoir pour effet :

  1. d'exclure une responsabilité qui ne peut légalement être exclue ;
  2. de limiter les droits impératifs du consommateur ;
  3. de supprimer ou de réduire les garanties légales applicables.

Le Vendeur ne peut être tenu responsable d'un retard ou d'une inexécution résultant d'un événement indépendant de sa volonté lorsque la législation applicable permet une telle limitation.

25. FORCE MAJEURE

Le Vendeur ne peut être tenu responsable d'une inexécution ou d'un retard directement imputable à un événement échappant raisonnablement à son contrôle, notamment en cas de catastrophe naturelle, incendie, panne majeure, grève, perturbation importante des services postaux ou de transport, défaillance générale des réseaux de communication ou événement similaire.

Cette clause ne limite pas les droits impératifs du consommateur.

26. MODIFICATION DES CGV

Le Vendeur peut modifier les présentes CGV pour les commandes futures.

Les CGV applicables à une commande sont celles acceptées par le Client au moment de cette commande.

Lorsqu'une modification affecte un abonnement en cours, le Vendeur respecte les règles légales applicables et, lorsque cela est nécessaire, informe préalablement le Client.

27. DROIT APPLICABLE ET PROTECTION DU CONSOMMATEUR

Les présentes CGV sont interprétées conformément au droit applicable au contrat.

Lorsque le Client est un consommateur résidant dans un pays dont les dispositions impératives de protection du consommateur s'appliquent au contrat, ces dispositions restent applicables même lorsqu'une autre loi est désignée comme loi applicable.

Aucune clause des présentes CGV ne prive le consommateur des protections impératives dont il bénéficie en vertu du droit de son pays de résidence lorsque ces protections sont applicables.

28. JURIDICTION COMPÉTENTE

En cas de litige avec un consommateur, les règles de compétence juridictionnelle applicables dans le pays de résidence du consommateur sont respectées.

Le consommateur peut exercer les recours qui lui sont ouverts par la législation applicable.

29. NULLITÉ PARTIELLE

Si une disposition des présentes CGV est déclarée invalide, illégale ou inapplicable, cette invalidité n'affectera pas les autres dispositions, dans la mesure permise par la législation applicable.

La disposition concernée sera, lorsque cela est légalement possible, interprétée ou remplacée de manière à respecter au mieux l'objectif initial de la clause tout en restant conforme au droit applicable.

30. ABSENCE DE RENONCIATION

Le fait pour le Vendeur de ne pas se prévaloir immédiatement d'un droit prévu par les présentes CGV ne constitue pas une renonciation à ce droit.

31. VERSION DES CGV

Les présentes CGV sont rédigées en français.

En cas de traduction dans une autre langue, la version applicable au Client est celle qui lui a été présentée conformément aux règles impératives applicables au contrat.
